Persons in Detention
You may be entitled to a Council Tax discount if a resident in the property is detained in a prison, hospital or any other place by the order of a court.
To qualify the person in detention must be detained:
- in a prison, a hospital or any other place ordered by a court in the UK or a Standing Civilian Court established under the Armed Forces Act, or
- under the Immigration Act, or
- under specific sections of the Mental Health Act or Mental Health (Care and Treatment) (Scotland) Act, or
- for more than 48 hours, under the Army Act, Air Force Act or Naval Discipline Act and not under open arrest, or
- temporarily discharged or released under the Prison Act or the Prisons (Scotland) Act.
A person detained for non-payment of a fine does not qualify.
Note: If all the residents in the property are in detention they may be entitled to an exemption.
