Occupation Prohibited by Law

You may be entitled to a Council Tax exemption if occupation of the property is prohibited by law.

How does the property qualify for an exemption?

The unoccupied property can be furnished and:

  • occupation is prohibited by law; or
  • the property is unoccupied because action is being taken to prohibit occupation or to acquire it.

Any prohibition in public law is relevant to this exemption.  This will include houses that are unfit for human habitation and in respect of which a planning condition prohibits occupation.

 

How long will the exemption last?

The exemption will last for as long as the qualifying conditions exist.
