Section 59 of the Roads (Scotland) Act 1984 prohibits the placement of anything on the public road that could constitute an obstruction, unless the written consent of the Roads Authority is given.

Should you wish a permit to place tables and chairs on the public road/footway outside your business, please complete the below application form and, attaching a detailed and numbered plan of your proposals, send to roadworks@westlothian.gov.uk (opens new window)
Not all locations are suitable for tables and chairs. To ensure the free movement of all the users of our footways a minimum unobstructed with of 1.5m must be available when the footway is occupied. On receipt of an application it will be assessed by council officers and consent will be given in writing if applicable.
Permits run for a maximum period of 12 months and will be subject to our standard conditions for tables and chairs, which are contained within the application form. The council may apply further conditions as deemed appropriate.
The cost of a S.59 permit is £240.34. Please note payment information will be provided once we have processed your application.
