Local Development Plan (LDP 1) Proposed Delivery Programme / Action Programme

The Delivery Programme (previously Action Programme) signals an important transition from the plan making stage to the plan delivery stage, identifying the actions, timescales and agencies required to deliver the plan.

On 11 June 2024, West Lothian Council approved a proposed Delivery Programme in respect of its adopted Local Development Plan 1 (LDP 1 2018) for publication and consultation.

The Delivery Programme sets out the infrastructure actions and guidance which are necessary to implement the council's current Local Development Plan.

The Delivery Programme is presented as 7 schedules:

• Schedule 1 - Completed Actions

• Schedule 2 - West Lothian Council's Housing Delivery Programme and Pipeline

• Schedule 3 - Strategic Transport Actions

• Schedule 4 - Education Actions

• Schedule 5 - Open Space and Greenspace Actions

• Schedule 6 - Core Development Areas and site-specific actions - housing land allocations

• Schedule 7 - Site specific actions - employment land allocations

• Schedule 8 - Policy Actions

• Schedule 9 - Supplementary Guidance and Planning Guidance

Comments on the proposed Delivery Programme were invited by 12 Noon on Friday 2 August 2024 but the consultation has now closed.

Representations will in due course be considered, responded to and reported to elected members at the earliest opportunity. It is currently anticipated the finalised Delivery Programme will be presented to West Lothian Council for approval in November 2024.

It should be noted that because representations have been received it could potentially give rise to revisions being made to the Delivery Programme prior to it being finalised.

Background

At the time of the adoption of the West Lothian Local Development Plan 2018 the council was required to publish an Action Programme to support delivery of the plan.

The Action Programme was prepared with input from across the council, the relevant key agencies and other organisations. The first Action Programme following the adoption of the West Lothian Local Development Plan (LDP 1) was published and submitted to Scottish Ministers in February 2019.

An Action Programme must be kept up to date and be re-published whenever required by the Scottish Ministers, or whenever an authority think it appropriate to do so, but in any event within 2 years after last publishing (or re-publishing) it.

The second Action Programme (first review of the original Action Programme) was submitted to Scottish Ministers in January 2021 (delayed because of Covid 19).

Prior to preparation of the third review of the Action Programme, regulations amended the process of preparing an Action Programme and required authorities to review, update, consult and re-publish the Action Programme as a Delivery Programme.

However, in August 2023 an application to the Court of Session (Miller Homes v Scottish Ministers 'Mossend') challenged the use of National Planning Framework 4 Policy 16 in relation to housing delivery prior to the adoption of a new NPF4 compliant Local Development Plan. The case also raised the issue of whether a Delivery Programme rather than an Action Programme could be provided under LDPs published prior to NPF4. Preparation of the first Delivery Programme for LDP 1 to comply with the regulations was paused until this case was resolved.

The Court of Session Judgement was issued on the 3 May 2024 and served to clarify that Action Programmes can be now be reviewed and subsequently published as Delivery Programmes and this  enabled the council to commence a public consultation in June 2024.
