Information held about you

We are the Corporate Communications team for West Lothian Council and we operate a drone to capture images of council services and images of West Lothian generally. We are the data controller for this service.

Why do we have your information?

The council uses drone footage to capture images of council owned facilities for promotional purposes. The team will also capture other images of West Lothian to promote West Lothian generally, and local services. Landowner permission where necessary will be obtained at all times.

In the vast majority of occasions, and as a standard practice, any images of people or vehicles that could reasonably assist in identifying a person/persons will be obscured in our final edit before publication.

How will we use information we hold about you?

The council uses drone footage to capture images of council owned facilities for promotional purposes. The images will be used on promotional channels such as social media and websites.

Who we will share your information with?

Personal data means any information relating to an identified or identifiable individual.

If an image can be used to identify a living individual, that image is therefore likely to constitute personal data. This includes where individuals in an image are named, and also covers situations where no names are used but other contextual information would enable individuals to be identified.

We do not collect or store any personal information such as names, contact details or addresses - only images.

We store images taken from our drone. The footage is taken from public areas and from private areas (whereby we have sought consent from the land owner to film). The council does not have to seek the permission of an individual or individuals to capture images.

We will not:
  • transfer your data outside the European Economic Area (EEA)
  • sell or rent your data to third parties
  • share your data with third parties for marketing purposes

How long do we keep your records?

All information/footage will be used for promotional material.

In the majority of occasions once a final edit is produced, all raw footage containing unobscured images will be deleted. This will be done within one month of recording the original footage. Footage whereby all images have been obscured will be kept for 10 years.

If footage is required that contains images of people that can be identified (as mentioned above), the images will be kept for 10 years.

Your rights

You have a number of rights under data protection law, including the right to request your information and to request that the information be amended if incorrect or, in some circumstances, erased.
